Your Residency-for-Tax-Purposes is often different to your citizen or migration status. It determines the income you must include, and the tax rates and offsets that apply. This is a summary of options;
Permanent – you maintained a permanent home in Australia, even if you went overseas temporarily. Resident tax rates and offsets apply, and you include your worldwide income.
Foreign Resident – your usual & permanent home remains or has become overseas, and unless you satisfy further criteria then Non-resident tax rates will apply, but only to Australian income.
Temporary Resident – this applies to some Foreign Residents with a valid work or business visa. Resident tax rates & offsets apply, and only to Australian income or overseas employment during the visa.
Student Visa – for overseas students attending a recognised course of 6 months or more. Like a Temporary Resident, Resident tax rates & offsets apply to Australian income only.
Working Holiday Visa – new WHM tax rates apply from 1/1/17, on Australian income only. You may claim tax residency for income before that date, but ATO conditions have also become tougher.
The Medicare Levy automatically applies to all those claiming Tax Residency status. It will not apply to Tax Non-Residents.
The Medicare Levy is a flat 2% tax based on total taxable income.
A Medicare Levy Surcharge of 1% to 1.5% also arises if income exceeds $90,000 and you did not have Aust private health insurance.
Medicare Levy Reductions will remove the Levy if income is under $21,655, or reduce it for families or dependants. Reductions are purely based on other info you enter in the return and Offsets section.
A Foreign Resident Exemption can be claimed if you have Tax Resident status. This may include those on Temporary, Student or Working Holiday visas. A Tax Non-resident does not need an exemption.
Exemption Condition - NO entitlement to a Medicare card or benefits;
- under your name or as part of a family
- under a reciprocal benefit scheme with your country of origin
- and are not a permanent citizen who remains entitled
A Medicare Entitlement Statement must be applied for each year, before before lodging your return. As Tax Agents we can attend to this on your behalf, and generally without any delay to your tax return.
Application Process You must complete our declaration in our return submission and upload the photo and visa pages in your passport. We will then only contact you if needed. A small processing fee applies.
